Of course you are press. Noah Feldman’s reasoning is pretty self centered, to say the least. He seems to argue that since the constitution guarantees a free press, the governor of California can’t restrict the movements of a member of the press (whoever that is). But, the constitution also protects the right to bear arms. Is Feldman going to defend the rights of a gun store to stay open? There the small matter of the constitutional right to free assembly, which would seem to blow up the whole thing, if you thought the first amendment applied. Feldman seems to argue that the “press” deserve some special protection beyond the normal constitutional rights that apply to lesser folks. Obnoxious just begins to cover it. Just for the record, I agree the order is a mess, I just wouldn’t lead with the lack of a press exemption.
